These General Terms and Conditions of Sale (the "Terms") govern sales concluded on the noila.fr website between Noïla and any Customer making an online purchase.
Confirming an order implies full and unreserved acceptance of these Terms.
INTRODUCTION
In these Terms:
"Seller," "Noïla," "We" refer to the operator of the Site;
"Customer," "You," "Consumer" refer to any natural person of legal age acting for non-professional purposes;
"Site" refers to the website accessible at: noila.fr.

1. APPLICATION OF THE TERMS
These Terms are accessible at any time on the Site.
Before confirming their order, the Customer acknowledges having read these Terms and accepts them without reservation by checking the box provided for this purpose.
These Terms apply to any order placed on the Site.
Noïla reserves the right to modify these Terms at any time. The applicable Terms are those in effect on the date the order is confirmed.
The Customer declares that they are of legal age and have the legal capacity to enter into a contract.
2. PRODUCTS
The products offered for sale are hair cosmetics.
The products offered for sale are those listed on the Site, subject to available stock.
Each product has a description sheet specifying, in particular:
- its essential characteristics;
- instructions for use;
- precautions for use;
- INCI composition.
Photographs, illustrations, visuals, and descriptions on the Site are provided for informational purposes only and are not contractual. Slight variations may exist between the visuals shown and the products delivered without engaging Noïla's liability.
Results may vary depending on, in particular:
- hair type;
- scalp condition;
- hair care routine;
- individual sensitivity.
Customers are invited to carefully review the ingredient list (INCI) before purchase.
In the event of a known allergy, sensitivity, reactive condition, or specific dermatological treatment, a patch test is recommended before use.
Noïla cannot be held liable for a reaction related to a known or undeclared allergy, individual sensitivity, personal incompatibility, or improper use.
Products marketed by Noïla comply with applicable provisions of Regulation (EC) No. 1223/2009 on cosmetic products.
Applicable regulatory obligations, including the preparation of required regulatory files and declarations, are carried out in accordance with current regulations.
Availability
Product offers are valid as long as they are visible on the Site and subject to available stock.
In the event of unavailability after an order is confirmed, the Customer will be informed as soon as possible.
If payment has already been made, a refund will be issued within a maximum of 14 days.
3. ORDERING
The ordering process includes the following steps:
- product selection;
- adding to cart;
- cart review;
- entering contact details;
- reviewing information;
- accepting the Terms;
- secure payment;
- order confirmation.
Once payment is confirmed, a confirmation email is sent to the Customer.
The order becomes final upon this confirmation.
Any request for modification or cancellation after confirmation is subject to Noïla's express agreement, without prejudice to the Customer's legal rights.
Noïla reserves the right to refuse or cancel any order for legitimate reasons, including:
- prior dispute;
- suspected fraud;
- abnormal order;
- product unavailability.
4. PRICE AND PAYMENT
Prices are shown in euros (€), inclusive of all taxes.
The applicable price is the one displayed at the time the order is confirmed.
Noïla reserves the right to change its prices at any time, with no retroactive effect on confirmed orders.
Applicable delivery charges are shown before final confirmation.
For orders outside the European Union, taxes, customs duties, or import charges may apply and remain the sole responsibility of the Customer.

5. DELIVERY
Noïla delivers within France as well as to certain European countries offered at the time of order.

Chronopost
Available destinations, applicable fees, and estimated delivery times are indicated before confirmation.
Orders are prepared within 24 to 48 business hours, excluding weekends and public holidays.
Products are shipped to the address provided by the Customer.
The Customer is solely responsible for the accuracy of the information provided.
Any address error or omission resulting in additional charges remains the Customer's responsibility.
If a parcel is refused, unclaimed, not collected within the allotted time, or returned due to an incomplete or incorrect address, shipping and return costs will not be refunded and will remain the Customer's responsibility.
Timeframes
The timeframes indicated are estimates.
In the event of a delay exceeding 30 days, excluding force majeure or fault attributable to the Customer, the Customer may request the cancellation of the sale in accordance with Articles L216-2 et seq. of the French Consumer Code.
The refund will be issued within a maximum of 14 days.
6. RECEIPT – ANOMALIES – DEFECTIVE PRODUCTS
In the event of a damaged parcel, the Customer is invited to:
- refuse the parcel;
- note specific reservations with the carrier;
- take photographs;
- contact Noïla promptly.
In the event of a missing, non-conforming, damaged product, or an apparent anomaly, the Customer is invited to contact customer service within 3 business days of receipt.
This timeframe is a recommendation and does not limit legal warranties.
7. RIGHT OF WITHDRAWAL
In accordance with Articles L221-18 et seq. of the French Consumer Code, the Customer has a period of 14 days from receipt to exercise their right of withdrawal.

Return costs remain the Customer's responsibility.
Return conditions
The product must be:
- unopened;
- unused;
- returned in its original packaging;
- accompanied by proof of purchase.
8. EXCLUSIONS FROM THE RIGHT OF WITHDRAWAL
In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to:
- unsealed cosmetic products;
- opened products;
- used products;
- personalized products.
For hygiene and health protection reasons, no refund can be issued for an opened or used product.
9. RETURNS
No return may be made without prior written approval from customer service.
The Customer must contact:

No return should be made without prior approval.
Any parcel returned without prior approval may be refused.
Return costs are the Customer's responsibility except in the case of:
- preparation error;
- defective product;
- error attributable to Noïla.
10. LEGAL WARRANTIES
The Customer benefits from:
- the legal warranty of conformity (Articles L217-3 et seq. of the French Consumer Code);
- the warranty against hidden defects (Articles 1641 et seq. of the French Civil Code).
The Customer may request repair, replacement, price reduction, or refund in accordance with applicable legal conditions.
11. LIABILITY
Noïla cannot be held liable for damages resulting from:
- improper use of the products;
- failure to follow instructions for use;
- misuse.
The Customer is invited to carefully review the product composition before use.
In the event of a known allergy, particular sensitivity, or specific dermatological treatment, it is the Customer's responsibility to verify the product's compatibility before use.
Noïla's liability cannot be engaged in the event of a reaction related to individual sensitivity or improper use.
12. INTELLECTUAL PROPERTY
All content on the Site as well as the NOÏLA brand (text, visuals, photographs, graphics, logo, videos) are protected under applicable intellectual property law.
Any reproduction, representation, exploitation, or use, in whole or in part, without prior written authorization, is strictly prohibited.
13. PERSONAL DATA
The data collected is necessary for:
- order fulfillment;
- customer relations;
- administrative management.

16. GOVERNING LAW
These Terms are governed by French law.
They apply to all sales made via the noila.fr website, including for orders delivered within the European Union as well as to countries offered at the time of order.
In accordance with applicable consumer protection rules, Customers residing in another country may nevertheless benefit from the mandatory, more protective provisions of their country of residence.
Failing an amicable agreement, the dispute may be brought before the competent courts in accordance with applicable legal provisions.
